Guardianship Practices in California
BPA conducted a multi-phased study of guardianship practices in the state of California for the Administrative Office of the Courts (AOC). Little information previously existed about guardianship processes in the probate and juvenile court systems, as well as other court systems. This project was intended to provide the AOC with useful information about guardianship court practices, including: information and services available to prospective guardians, investigation requirements, collaboration efforts between different courts, and challenges and innovative strategies faced by different guardianship systems across the state. The project utilized several data collection methods, including a telephone survey conducted in California's 58 counties; focus groups with representatives from probate and juvenile courts, court administrators, probate examiners/ investigators, social workers, and attorneys; bench officer interviews; and in-depth research, including telephone interviews and document review, of model guardianship court systems. The information gathered through the study helps to articulate the story of guardianship practices in California and may inform future legislative and rule-making efforts in the state.
